How much is the Overstaying Fee for Tourists in the Philippines?
Most Tourists to the Philippines are allowed to stay for 30 days before needing to apply for a Visa. The first Tourist Visa extension is the initial extension of twenty-nine (29) days, taking the visit up to 59 days.
This is commonly followed by a two month extension, although some Bureau of Immigration offices allow a 6 month extension.
If a person stay in the Philippines without a Valid Visitor Visa, then penalties are applied, and added to the unpaid Visa fees.
These combined penalties and fees can add up over time and can be something like the following figures:

Note: These are approximate costs. Immigration will determine the exact cost when you visit their office.
A reasonable ‘estimate’ can be made by calculating 3,000 pesos for every month of Overstay. Or about 30,000 for each year.
These figures are approximate calculations based on 2016 fees. They may reduce the cost if they base it on the actual fees dues for older years, which may be less than the 2016 fees.
Charges can also be higher in some cases, such as one example in the comments below:

Financial Penalties for Visa Overstay in the Philippines:
The minimum penalties appear to be:
- All Visa Extension Fees not previously paid.
- Fine for Overstaying – (additional) Php 500.00 per month
- Motion for Reconsideration for Overstaying – (additional) Php 500.00
I have read that the Overstay fee for just a few days would be about 4,000 pesos.
This would be the 3,030 peso first Visa Extension fee + Overstay Fees. (2015 fees)
If the Overstay is for over one month, but less than two months, then I would guess that the fee would be closer to 12,000 peso, made up as follows:
3,030 pesos – First Visa Extension fee
7,340 pesos – Next Visa Extension fee plus the ACR-i card fee
1,000 pesos – Fine for Overstaying (2 months)
500 pesos – Motion for Reconsideration for Overstaying
If the Overstay is for just over one year, then I would guess that the fee would be closer to 35,000 peso, PLUS possible DEPORTATION. The fee would be made up as follows (assume figures for 13 months):
3,030 pesos – First Visa Extension fee
22,490 pesos – Six x 2 month Visa Extension fees plus the ACR-i card fee
6,000 pesos – Fine for Overstaying (12 months)
500 pesos – Motion for Reconsideration for Overstaying
plus maybe one ACR-i card renewal fee

The Official Statement for Visa Extensions is:
Foreigners admitted under Section 9 (a) of the Philippine Immigration Act (PIA) of 1940, as amended, or Executive Order No. 408, as amended, may extend their authorized stay every two (2) months for a total stay of not more than:
– a) Twenty-four (24) months for visa-required nationals; and
– b) Thirty-six (36) months for non-visa required nationals.
The said periods shall be counted from the date of applicant’s latest recorded arrival.
Overstaying Foreigners in the Philippines
Foreigners who have overstayed for twelve (12) months or less but have been in the country beyond the maximum allowable period already may be permitted to update their stay with order to leave the country within fifteen (15) calendar days therefrom and their names may be included in the Bureau’s blacklist upon the discretion of the Commissioner; Provided that, the Commissioner, in the exercise of sound judgment, may allow such foreigners to update and extend their stay taking into consideration their Filipino lineage, medical condition, minority and other analogous circumstances.
Foreigners who have overstayed for more than twelve (12) months regardless if their stay is within the maximum allowable period or those found to be overstaying by virtue to a complaint or Mission Order regardless of the period shall be referred for deportation.

I am pretty sure they are normally lenient during the COVID times, so you need to get to an office when you can, and sort it out.
I did read that you need to apply for an extension within 30 days after the lockdown is lifted. Otherwise normal rules apply, fines etc.
That should mean you just pay the fines, and leave.

No more quarantine measures, just mainly the vaccine to fly out now. Go talk to immigration, they are pretty understanding. I think you can plead your case if you show the receipt for the online scam to them. Also request a reconsideration for your visa to be updated. You will need to pay overstay fees but you should have time to plan an exit. I would not fear them, just be honest and they should work with you to help you exit. If you have no money, you can declare indigent status. In that case go to your country’s embassy first. Good luck.

Individuals or groups with personal and qualified information on overstaying foreign nationals may report such fact to the BI’s National Operations Center (BINOC) through text message (SMS) to the following mobile phone numbers: Globe: +63917-573-3871 ; Smart: +63908-894-6644 ; Sun: +63932-894-6644. Full Name of Foreigner Complete Address Name of Informant.
Reports containing the pertinent information must specifically be sent in the following format: SIM
Upon sending of the message, the informant will receive a reply from the BI acknowledging receipt with a statement that such information will be verified and validated. Once validated, the informant will be advised of the results of the verification and investigation.
A financial incentive of Php 2,000.00 shall be given to the informant upon successful apprehension of the overstaying alien.
Any information received by the BI will be treated with utmost confidentiality.
I worry a bit about these things, as they may approach the over-stayer and say something like, “We have been told by [your name] that you are an over-stayer, etc…”

There are no guarantees, but not everyone gets deported. Having a child, presumably a Filipino child, should count for something. Your husband should visit the immigration office and explain the situation, and begin the process to get your visa status sorted out. The two year penalty is about 60,000 pesos. I suggest asking about the marriage visa while he is at the immigration office.

Under 1 year is almost no chance of deportation. Not everyone, even over 1 year overstay, gets deported.

If your child has a Philippine passport they can leave the Philippines to enter Hong Kong without a visa and not face any travel issue.
Using a Hong Kong passport they will be treated as a foreigner and the subsequent Philippine visa overstay issues.

Two years overstay is normally about 60,000 peso, and needs to be done as soon as possible, and at the same time apply for the ECC, without that she will not be allowed to leave.
Go to an immigration office as soon as you can, to ensure no delays to the planned flight.

To avoid any possibility of deportation you should obtain Filipino Citizenship for her too.
A one year overstay will be about 30,000.
With a Filipino passport, travelling to most countries, there would not be an issue with any visa penalties.
These only occur when needing to use the foreign passport.

It should not be more than 13,000, for between 2 and 3 months overstay. It might be about 9,000, for just two months if no ACR-I card is needed.

You say you arrived 9th March, and had a visa until 9th April. So it is only a one month overstay on that basis. It may only be just over 4,300 if you get in quick.
Go to immigration by 9th May, to get the cheapest cost. Do not wait longer. No need to book the flight before getting the visa up to date.

My son’s Balikbayan visa is extended until July 31, 2018. But our flight going to Hong Kong is on August 4, 2018. Now I want to know how much is the daily penalty for exceeded days.
Unfortunately, my in-laws did the visa extension for my sons and they forgot to ask how much will the penalty cost per day.

It could be up to about 4,000 pesos, and he might need an ECC as well on exit. You need to check with immigration well before the flight, and renew correctly to avoid missing a flight, while being sent back to an immigration office in the city, instead of being allowed to board the plane.
There never was a daily penalty rate, it was a monthly minimum, and could not normally be done at the airport.

Assuming it is the same as a visitor visa, then it would be about 60,000 pesos, but also a possible deportation and blacklisting.
The cost would be a minimum of the above, or two years student visa costs plus penalty fee of about 12,000 pesos.

The cost is not much higher than the normal renewal fee.

As a Philippine passport holder she is a Philippine citizen and is not overstaying.
She will have no problem going in and out of the country, using her Philippine passport, as a normal citizen.
The problem arises if she tries to use her Japanese passport to leave the Philippines. At that point they can treat her as a foreigner, and require different exit procedures.
If she travels to Japan on her Philippine passport they will need to see a visa for Japan. But she can’t get one.
If she travels to Japan on a Japanese passport, she is a foreigner, and can be treated as an overstayer.
If she travels to Hong Kong, on her Philippine passport, no visa needed for Philippine Citizens, then on to Japan on her Japanese passport, on a separate ticket, she avoids the hassles.
It is a ridiculous situation, but a Philippine oddity.
I am hoping they change that rule at some stage for dual citizens.

The Japanese embassy will not be involved with any penalties, so there should be no problem in getting the passport.
As a Japanese citizen, the Japanese embassy would say no visa, as they have a Japanese passport. However, you could ask them when you visit the Embassy. It may be possible with an expired Japanese passport .

It is normally done on a per month basis.
So it is the cost of a normal visa renewal plus the penalty.
Some have said they got away with nothing for one day, others 3,000 at the airport, and others being sent to an Immigration office in the city and paying 4,000, plus missing the flight.
The problem being that they have become illegal aliens at the point that the visa has not been renewed on time.
Penalties are the same, no matter what nationality.

You do need to look into getting the marriage visa first.
However, a call to the Department of Foreign Affairs might be the first step. Ask if he can get citizenship due to parents original Filipino status. I am not sure if it can be done, but it might be worth asking first.
If not, then ask immigration about the situation on getting a marriage visa, and if he needs up to date visa to apply.
A five year overstay is about 150,000 pisos. But the risk is also deportation and a re-entry ban. Check on the marriage visa rules first, and see if there are any exemptions to deportation etc., for marriage visa applicants.

To avoid paying a penalty, she must travel on a Philippines passport to a country that does not need a visa. And then fly to Turkey from there.
If she travels on a foreign passport, she must adhere to all immigration laws relating to foreign passport holders. That includes holding valid visas, and having the ECC.
I have heard that some in your position arrive at the airport with both passports (Turkish and Philippines in your case) and are allowed to leave with no issue. However, I am not sure if it is allowed every time.
My husband is Australian and he arrived here December of 2016. He already applied for a 2-month tourist visa before coming here. We got married Feb of 2017 and since then, we were able to renew his visa for 2 six-month extension. His visa expired a few days ago. Would he still be able to get another six-month extension?
You can stay for up to 36 months, with renewing visas.
A few days overstay, with a reasonable reason should not be a problem for renewal. However, this is the Philippines.
I would go in and get it done ASAP, don’t leave it too late.

I have not seen any information on student visa penalties.
I would assume it will be similar, but at a minimum it would be all the previous unpaid visa fees, ACR cards etc., plus penalties of around 1,000 per month.
They may switch a finished student visa to a tourist visa, and then the penalties shown above would apply.

Depending on how long the overstay is, you are looking at about 30,000 peso per year.
If the overstay is excessive, such as p150,000, can this amount be financed to make monthly payments and could it be under ten K per month till paid if the payer is also supporting a Filipino child?
I have not heard of that being available.
You can ask immigration, but I doubt if they will consider it. They may say that these are for visa payments that should have been paid a long time ago.
They technically have the right to enforce imprisonment. But that is, as far as I am aware, very rarely done.
It may be better to ask the Embassy for help in that issue.
I arrived here in Philippines Dec 1, 2017, and passport stamped renew by Dec 30, 2018 I ended up being 3 days late due to B.I closed for holiday. This month (April) I was late 2 days because of Philippine Holiday. I cannot renew on time again (April 30) because salary not until May 4. I will have been late 3 time’s and I’m wondering if there is risk of being deported for being late 3 or more time? I will await your reply and I appreciate any advice .
For such short overstays with reasonable reasons, I would think it very unlikely.

A 2 day overstay is uncertain. Some have to do a full months renewal, so about 3,000 pesos, but others have been let off.

Any overstay over 12 months ‘can’ lead to deportation and being blacklisted.

He needs to go to the local immigration office, and do it there. It can take 24-48 hours to do it, with the ACR card renewal and the ECC certificate to allow departure, and that is for people with up to date visas.
If I was him, I would be arranging it as soon as possible. I had a 3 hour delay at the airport, just for not having the ECC once, (just after they began enforcing the law) and was very lucky not to miss my flight.

10 years staying illegally without a visa is almost certainly guaranteed a future blacklisting.
Trying to leave without paying all visas and penalties could involve a prison term, although I haven’t heard about many recently.
I would suggest asking advice from his own Embassy, they may be able to give better independent help.

You are looking at about 30,000 pesos for a Twelve Month Overstay.
It would be worth asking at immigration about a marriage visa after that.

My question admin, can he pay the over staying and visa charges at the airport immigration when he leave? he is outside manila now therefore, going to the Manila immigration is impossible. and what are the consequences he may encounter the next time he will visit the Philippines again?

Some people have paid at the airport with a day overstay, but most that I am aware of, with longer overstays, are sent to Manila to sort out a new visa.
Systems do change though.

The financial requirements for a British person to take a spouse to the UK is either:
An annual income of: £18,600 or
A capital sum of: £62,500 in the bank
Your figure of 14,000,000 pesos is £188,000
The only amount that the UK embassy would actually collect is the application fee of about £1,600 or 120,000 peso.
Also, a 2 year overstay would not incur a 15 year prison sentence. Maybe 60,000 pesos payable to Philippines

The medical condition may not make any difference.
However, you can try to explain, to immigration, why his medical condition stopped him, or someone on his behalf, from renewing his visa for 8 years.

If you currently do not have a valid visa, then yes, you are not legal in the country.
You need to get that visa situation sorted out first, and pay the visa costs and penalties, to get yourself a legal status in the country again.

My kids who are 20 now went to Philippines in Sept. 2012 with their grandparents to go to school there. I was u see the impression they applied them for dual citizenship but just found out they did not. How much will I have to pay to get them back here to the US?
About 6 years overstay each. Nearly 200,000 pesos each.
I am not sure what other options are available. But as foreign citizens they need all visas up to date to be able to get the Exit Certificate ECC.
Dual citizenship might have made it easier, but some have said even that didn’t help.

You are looking at around 400,000 peso costs, and probably deportation and banning from future entry.
A marriage visa would be the best option, and maybe that would help with avoiding deportation.
In your situation I would suggest asking a migration lawyer, as you might need them so he can stay in the Philippines.
Approaching immigration together and explaining the situation, offering to pay all the past due visa costs, asking for a marriage visa and showing marriage details etc, might help. But an immigration expert in that might be best.

4 years overstay will be about 120,000 pesos based on this:
60,000 Total for Up to Two Years Overstay (and then about 30,000 for each year)
150,000 Total for Up to Five Years Overstay
There is uncertainty on dual citizen children. Some people have had to pay while others say they have managed to avoid it.
In your situation, it would be best to apply for a marriage visa.
Men who are married to a Filipina can apply for citizenship, after a residency of five years in the Philippines. Most others need 10 years residency.
Actually all you have to do is to go to the US Embassy window 1 you don’t have to get an appointment..

It might depend on the visa he has. A visitor visa holder must sort out unpaid visas and get an ECC, before going to the airport.

I have a question, so I have been staying in the Philippines will be 5 years in Nonmember. I applied for dual citizenship before i planned to go here. I processed everything but when I got here all I had was a US passport. They told me to get a Philippine Passport as well but I never got to it.i recently got my purse stole with all of my documents and passport stolen as well. Do they keep things like this on file i will be heading to the embassy next week and i don’t want to be given a hard time.
If you have been confirmed as a Philippine Citizen, then their records should show that, and you should be able to get a Philippine passport.
You mention going to the Embassy, I assume that is for the US passport. I would also assume that the US authorities would have your details on file to be able to sort out a replacement.

Hi all you have to do is to go to the US EMBASSY window 1 even without an appointment just tell your problem.Yes she will be blacklisted for 10 years unless she will pay for her overstaying fee.If she will go back to her country she will need a cover letter from the embassy and pass it to Immigration then the Immigration grant your requesr to leave in the country..FYI you will not pay even a single peso 🙂

It’s the Philippines Immigration that decide penalties and blacklist periods. Nothing to do with the United States.

As a Former Filipino Citizen, that might actually be possible to avoid the penalties.
I can see why a non filipino would have to sort out visa issues before going for citizenship, but a former Citizen, just regaining Citizenship, should be treated differently.

Goodeve admin i just want to ask the case of my girlfriend she was born here in the philippines his father is a japanese and mother is filipina and then thet went back to japan and she got her japanese passport and then when she was 4 yrs old they went back in the philippines and leave here shes 24 yrs old as of now and she got a philippine passport too is she a overstaying or what? Coz if she got a philippine passport she is consider as a filipino right?
As a Philippine passport holder she is a Philippine citizen and is not overstaying.
She will have no problem going in and out of the country, using her Philippine passport, as a normal citizen.
The problem arises if she tries to use her Japanese passport to leave the Philippines. At that point they can treat her as a foreigner, and require different exit procedures.
If she travels to Japan on her Philippine passport they will need to see a visa for Japan. But she can’t get one.
If she travels to Japan on a Japanese passport, she is a foreigner, and can be treated as an overstayer.
If she travels to Hong Kong, on her Philippine passport, no visa needed for Philippine Citizens, then on to Japan on her Japanese passport, on a separate ticket, she avoids the hassles.
It is a ridiculous situation, but a Philippine oddity.
I am hoping they change that rule at some stage for dual citizens.
