How much is the Overstaying Fee for Tourists in the Philippines?

Most Tourists to the Philippines are allowed to stay for 30 days before needing to apply for a Visa. The first Tourist Visa extension is the initial extension of twenty-nine (29) days, taking the visit up to 59 days.

This is commonly followed by a two month extension, although some Bureau of Immigration offices allow a 6 month extension.

If a person stay in the Philippines without a Valid Visitor Visa, then penalties are applied, and added to the unpaid Visa fees.

These combined penalties and fees can add up over time and can be something like the following figures:

Note: These are approximate costs Immigration will determine the exact cost when you visit their office.

A reasonable ‘estimate’ can be made by calculating 3,000 pesos for every month of Overstay. Or about 30,000 for each year.

These figures are approximate calculations based on 2016 fees. They may reduce the cost if they base it on the actual fees dues for older years, which may be less than the 2016 fees.

Charges can also be higher in some cases, such as one example in the comments below:

79,500 For a 19 months overstay.

Financial Penalties for Visa Overstay in the Philippines:

The minimum penalties appear to be:

  • All Visa Extension Fees not previously paid.
  • Fine for Overstaying – (additional) Php 500.00 per month
  • Motion for Reconsideration for Overstaying – (additional) Php 500.00

I have read that the Overstay fee for just a few days would be about 4,000 pesos.

This would be the 3,030 peso first Visa Extension fee + Overstay Fees.  (2015 fees)

If the Overstay is for over one month, but less than two months, then I would guess that the fee would be closer to 12,000 peso, made up as follows:

3,030 pesos – First Visa Extension fee
7,340 pesos – Next Visa Extension fee plus the ACR-i card fee
1,000 pesos – Fine for Overstaying (2 months)
500 pesos – Motion for Reconsideration for Overstaying

If the Overstay is for just over one year, then I would guess that the fee would be closer to 35,000 peso, PLUS possible DEPORTATION.  The fee would be made up as follows (assume figures for 13 months):

3,030 pesos – First Visa Extension fee
22,490 pesos – Six x 2 month Visa Extension fees plus the ACR-i card fee
6,000 pesos – Fine for Overstaying (12 months)
500 pesos – Motion for Reconsideration for Overstaying
plus maybe one ACR-i card renewal fee

That is my guess, based on the actual costs for Normal Visas last year.  If anyone has paid an Overstay Fee, please give details in the comments box below, showing the date and the fee paid and the total days overstayed.  Thank you.

The Official Statement for Visa Extensions is:

Foreigners admitted under Section 9 (a) of the Philippine Immigration Act (PIA) of 1940, as amended, or Executive Order No. 408, as amended, may extend their authorized stay every two (2) months for a total stay of not more than:
– a) Twenty-four (24) months for visa-required nationals; and
– b) Thirty-six (36) months for non-visa required nationals.

The said periods shall be counted from the date of applicant’s latest recorded arrival.

Overstaying Foreigners in the Philippines

Foreigners who have overstayed for twelve (12) months or less but have been in the country beyond the maximum allowable period already may be permitted to update their stay with order to leave the country within fifteen (15) calendar days therefrom and their names may be included in the Bureau’s blacklist upon the discretion of the Commissioner; Provided that, the Commissioner, in the exercise of sound judgment, may allow such foreigners to update and extend their stay taking into consideration their Filipino lineage, medical condition, minority and other analogous circumstances.

Foreigners who have overstayed for more than twelve (12) months regardless if their stay is within the maximum allowable period or those found to be overstaying by virtue to a complaint or Mission Order regardless of the period shall be referred for deportation.

I arrived here in the Philippines during the heat of the covid 19 pandemic which seemed like everyday a lockdown, I wanted to extend my visa but was unable to travel 5 hours away due to lockdowns and being told I would have to quarinetine for 14 there and once I got home which was insane! I have been here for 14 months expired visa I want to pay the fines fees and bring my visa up to date! I went with an online visa service which turned out to be a scam they scanned me for 60k peso no visa lying bastards so now I learn my visa expired I’m so paranoid that I’ve thought about kayaking from Palawan to the tip of Malaysia lol but I need to know can I just pay the fines and leave I don’t want to stay I want to leave this hell hole…ive been robbed scammed used and Im so fustrated !

No more quarantine measures, just mainly the vaccine to fly out now. Go talk to immigration, they are pretty understanding. I think you can plead your case if you show the receipt for the online scam to them. Also request a reconsideration for your visa to be updated. You will need to pay overstay fees but you should have time to plan an exit. I would not fear them, just be honest and they should work with you to help you exit. If you have no money, you can declare indigent status. In that case go to your country’s embassy first. Good luck.

Hi, Admin. My visa expired on the 19 September 2016. I would like to settle my outstanding penalties and leave the Philippines. I have committed no offences. Having read your article, I am assuming to pay around 60k for penalty charges. I would to know in the event I settle the outstanding charges, will I be deported and how is that process? Hi there, I have overstayed here in PH since the 28th of jan 2018, i lost all my money to my ex girlfriend. I moved from mindanao to where i am now in Olongapo. Iam now just over 5 months late paying my extension. I had bad advice from other forigners saying its no problem being several months late, just dont go over 12 months. After several months i thought to myself this cant be right. So i did some research and thought as i now have my finances back in order i better go pay. I went to the olongapo imigration, filled out all the forms, wrote the reasons why ive overstayed and yet in the intervieww i was denied an extension, i was told my reasons were not vaild, the guy there never even looked me in the eye. Denied my visa and told me to go to manila and apply there. This is where the confussion is. Surely if im denied why did they not detain me there and then? why give me back my passport and let me leave? I am now really worried. I am going to go Manila tomorrow to extend. Did he send me there because he was in a bad mood, didnt want the paperwork, or thought i would go there and get deported easier? I really dont know. Have you heard of such a thing before. Any info before tomorrow would be very helpful.

Please i need your advise, as i’m married here in the Philippines and my tourist visa is due to expire on the 15th of July and my passport would expire by 28th of November 2018, which implies 4months validity. I have tried numerously to renew my passport from the moment it remained 6months to expire, but my embassy only process passport renewal applications twice yearly i.e January and July.

I have gone to the Angeles city Immigration office but they insisted i can’t be permitted renewal unless i obtain a new passport. What do you suggest or advise i do as my embassy is fully consented.

Secondly, what’re the requirements for applying for a TRV visa or any recommendable visa by your good and kind self? As i’m legally married with a filipina and all our kids possess Philippines citizenship as well and what the cost for the visa could approximately be.

Coincidentally, i’ve just received a mobile SMS alert from my embassy at about 6pm this evening to appear at the embassy on the 19th of July 2018. Which means i would be on 4days overstay by then, but they’re agreed to issue a memo addressed to the BOI so as to subside any possible penalties on my case upon issuance of the new passport. Meanwhile, I’ll embark on it ASAP with no further delays.

extended my 30 day free stsy to 59 days and was due to return to bi office on or before 10th june to extend a further two months and to purchase ACR card however for peronal reasons i was unable to be there . plan to gp on 9th july to pay extension fee, acr and the fine. around 7000 for 2 month extenson anf card but how much extra for my penalty/fine. need to prepare the money so i know. on 9th july i ll be overstaying a total of 28 days (june shorter month)

Are minor children under 15 years old assessed overstay fines or are they exempt as per ASEAN rules. Re: ASEAN – does The Philippines as a member country still comply with the member countries uniform rules regarding overstay fines?

My boyfee Came with a proposed student visa from nigeria last year August which was supposed to be extended after 3 months or so. But he failed to do so, he has not enrolled in any school yet, he has currently not renewed his visa & so will be termed an overstayer.

First of all high 5 to Admin…you have a great resource and you believe in follow up as well. Great Job. FOR THE MANY PEOPLE THAT ARE SCARED DO NOT LET WORRY AFFECT YOUR HEALTH. Just focus on what you can control. The US embassy will give you a loan and plane ticket if you have relatives that will receive you. And you must pay it back when you can. But long fees they will not pay ..For the people that are scared to go to immigration just go to a Travel Agent in the mall somewhere they know how to calculate the latest fees. You do not have to give them your IDs you are just asking questions. But of course they will be thinking whats in it for them so of course they will add their own fees if you would like them to process for you. Of course have to be careful with that. Many will frown on overstayers and think they are taking advantage and they are clueless some are stranded and trapped I understand it. Thanks to Admin.

I paid for my penalty of 1 year overstayed and extend to 2 months already which was in oct,2017 to december 2017 but my passport got lost within the week I was suppose to bring back my passport to immigration to put the stamp on so i ddnt get to get the stamp on my passport till now.
Will I have to pay it again?
Or just pay the penalty for now which is 10 months?
Luckily I found my passport was out of money that time so I am 10 months overstayed.
I still have the reciept for the one I already paid.
So admin please kindly let me know if I shud pay it again plus the 10 months overstayed or just the 10 months?

So I never dared to go to immigration until i had the amount, I have the amount now, actually 130K, but my friend said they might charger for additional/nonsense as well if u have bad luck? is there any way to avoid this? any way that i can be sure i pay exactly the true amount and not being fooled? im scared because I only have 130k, if they charge me more i will be stuck.

second, would it be advisable to book a ticket out of the philippines before gong to immigration? the same friend said that if you have a flight they will process it faster, or else they will take long?

If he is married in the Philippines and he has an ACR 13A vIsa he pay for 7 years 14000 Peso penalty if he go to the Immigration office with a valid passport,if the ACR is expiered again 2500 Peso extra plus application fees.If he was sick and not able to travel for 7 years and has no ACR (and even he have a ACR) I suggest strongly bring a medical certificate from a good doctor to the Immigration office .

Good evening sir. I’m a Canadian citizen who was born in the Philippines. I entered the Philippines last May 5th and was supposed to leave June 5th. Unfortunately I got sick the day before my flight and have now forfeited my return flight. I’m now planning to extend my stay up to mid July at the latest. I read somewhere that former Filipinos can stay for up to a year, provided they have a PH passport or NSO Birth certificate. Is this information accurate? Dear admin. One of my friend had submitted passport for student visa extension to our college visa incharge people. But our college visa incharge people didnt submit the passport immidietly to the immigration office even though they were knowing that visa is about to complete 6months in a week.
