How much is the Overstaying Fee for Tourists in the Philippines?

Most Tourists to the Philippines are allowed to stay for 30 days before needing to apply for a Visa. The first Tourist Visa extension is the initial extension of twenty-nine (29) days, taking the visit up to 59 days.

This is commonly followed by a two month extension, although some Bureau of Immigration offices allow a 6 month extension.

If a person stay in the Philippines without a Valid Visitor Visa, then penalties are applied, and added to the unpaid Visa fees.

These combined penalties and fees can add up over time and can be something like the following figures:

Note: These are approximate costs Immigration will determine the exact cost when you visit their office.

A reasonable ‘estimate’ can be made by calculating 3,000 pesos for every month of Overstay. Or about 30,000 for each year.

These figures are approximate calculations based on 2016 fees. They may reduce the cost if they base it on the actual fees dues for older years, which may be less than the 2016 fees.

Charges can also be higher in some cases, such as one example in the comments below:

Financial Penalties for Visa Overstay in the Philippines:

The minimum penalties appear to be:

  • All Visa Extension Fees not previously paid.
  • Fine for Overstaying – (additional) Php 500.00 per month
  • Motion for Reconsideration for Overstaying – (additional) Php 500.00

I have read that the Overstay fee for just a few days would be about 4,000 pesos.

This would be the 3,030 peso first Visa Extension fee + Overstay Fees.  (2015 fees)

If the Overstay is for over one month, but less than two months, then I would guess that the fee would be closer to 12,000 peso, made up as follows:

3,030 pesos – First Visa Extension fee
7,340 pesos – Next Visa Extension fee plus the ACR-i card fee
1,000 pesos – Fine for Overstaying (2 months)
500 pesos – Motion for Reconsideration for Overstaying

If the Overstay is for just over one year, then I would guess that the fee would be closer to 35,000 peso, PLUS possible DEPORTATION.  The fee would be made up as follows (assume figures for 13 months):

3,030 pesos – First Visa Extension fee
22,490 pesos – Six x 2 month Visa Extension fees plus the ACR-i card fee
6,000 pesos – Fine for Overstaying (12 months)
500 pesos – Motion for Reconsideration for Overstaying
plus maybe one ACR-i card renewal fee

That is my guess, based on the actual costs for Normal Visas last year.  If anyone has paid an Overstay Fee, please give details in the comments box below, showing the date and the fee paid and the total days overstayed.  Thank you.

The Official Statement for Visa Extensions is:

Foreigners admitted under Section 9 (a) of the Philippine Immigration Act (PIA) of 1940, as amended, or Executive Order No. 408, as amended, may extend their authorized stay every two (2) months for a total stay of not more than:
– a) Twenty-four (24) months for visa-required nationals; and
– b) Thirty-six (36) months for non-visa required nationals.

The said periods shall be counted from the date of applicant’s latest recorded arrival.

Overstaying Foreigners in the Philippines

Foreigners who have overstayed for twelve (12) months or less but have been in the country beyond the maximum allowable period already may be permitted to update their stay with order to leave the country within fifteen (15) calendar days therefrom and their names may be included in the Bureau’s blacklist upon the discretion of the Commissioner; Provided that, the Commissioner, in the exercise of sound judgment, may allow such foreigners to update and extend their stay taking into consideration their Filipino lineage, medical condition, minority and other analogous circumstances.

Foreigners who have overstayed for more than twelve (12) months regardless if their stay is within the maximum allowable period or those found to be overstaying by virtue to a complaint or Mission Order regardless of the period shall be referred for deportation.

I arrived here in the Philippines during the heat of the covid 19 pandemic which seemed like everyday a lockdown, I wanted to extend my visa but was unable to travel 5 hours away due to lockdowns and being told I would have to quarinetine for 14 there and once I got home which was insane! I have been here for 14 months expired visa I want to pay the fines fees and bring my visa up to date! I went with an online visa service which turned out to be a scam they scanned me for 60k peso no visa lying bastards so now I learn my visa expired I’m so paranoid that I’ve thought about kayaking from Palawan to the tip of Malaysia lol but I need to know can I just pay the fines and leave I don’t want to stay I want to leave this hell hole…ive been robbed scammed used and Im so fustrated !

No more quarantine measures, just mainly the vaccine to fly out now. Go talk to immigration, they are pretty understanding. I think you can plead your case if you show the receipt for the online scam to them. Also request a reconsideration for your visa to be updated. You will need to pay overstay fees but you should have time to plan an exit. I would not fear them, just be honest and they should work with you to help you exit. If you have no money, you can declare indigent status. In that case go to your country’s embassy first. Good luck.

When you passed all the documents required, will you get the rate and should pay the same day? If not were you given a deadline to settle the payment?

Hi . My daughter is a canadian citizen. we registered her in the philippine consulate . We brought her in the philippines last june 2015. Until now she is in the philippines and going back to canada this coming june 2017,basically almost 2 years now in philippines. we contacted philippine consulate here in canada last year they said your daughter will have no problem of overstaying because she is registered here in phil consulate. And today we contacted the consulate again and now the operator said that my child will be fined of overstaying. Any thoughts admin?

I have been living in the Philippines for 4 years after my student visa expired around January 28, 2013. Since then I have 2 kids with my Filipino girlfriend. I was not able to afford immigration penalties and fines and still am not willing and able to afford if those are the charges. If that is the matter/case regarding to the latter said, am I going to be deported and blacklisted?

I was born in the US but grew up here in the Philippines since I was 7.. The last time I was able to fly out to the US was back in 1999. Back in 1994 I was able to get a Philippine passport that indicated me having Filipino as my nationality alongside with my US Visa that says my nationality is a US Citizen. Iniwan po siya nung tatay niya, at mayroon po siyang stepmother na nag aalaga sa kanya. Ang problema po dito, 8 years old palang po siya nung iniwan po siya dito, at wala po siyang ka-alam alam tungkol sa visa. Nalaman niya lang po na kailangan niya pala ng visa months ago, at hindi niya po alam kung ano dapat niyang gawin dahil minor parin po siya, at natatakot po siyang humarap sa Bureau of Immigration dahil ayaw niya pong madeport. Wala din po siyang source of money/income, and for worst, wala daw po sa kanya ang passport. What she could do so that she won’t be deported? Naawa na po kasi ako sa kanya, kahit gusto ko po tulungan financially, I think hindi po yun possible because you stated that it would cost around 300,000 pesos for staying up to 10 years. Hello! I just like to inquire where and how can I report an overstaying foreigner who is aware that he has been overstaying in the Philippines but does not do anything about his Visa and his status. If my memory served me right, I believe we can report an overstaying foreigner as part of our responsibility to our nation. Hi Sir. May ask for guidance at least the process how my grandfather can go back to the U.S. He and my gradmother was filipino citizens and they were petitioned by my grandpa’s older brother. My grandparents was able to work there for more than ten years until got their american citizenship. They came back here in Philippines 6years ago which means they have overstayed as foreigner nationals since they haven’t applied for dual citizenship. My grandmother passed away last year so my grandpa will be the only one to go back to the U.S. May I know where and how much does he need to pay for overstaying? He couldn’t go back to korea because he said he got a problem there that would need to pay and that would need a long time and because we already have 2 baby he decided to stay here and tried to make money somehow. Hi admin! My fiancé who is an American citizen arrived here at May 2016 with the 3-month tourist visa. That visa expired on July 2016 and he has not yet renewed since then, due to financial problems. He will be able to renew his visa in the next few months and will not reach one year of overstaying for sure, but how much would he need to bring to pay for everything when he renews his visa(please include all expenses since I’m not really sure how this works and if he doesnt bring enough moeny, we might get in trouble)? Also, since he has overstayed for over 6 months, does that mean he will get deported and blacklisted? Are there cases wherein overstaying foreigners don’t get deported and blacklisted? He hasn’t caused any trouble during his stay here and the only reaosn why he wasn’t able to pay for the renewal earlier is because he was still financially incapable. And lastly, will he need to leave the country while his visa is being processed and for how long? Thank you!

Hi. Just want to ask something.. My boyfriend holds a Canadian passport and had a student visa. He came here to study last may 2015. He was just able to finish 14 units. He had INC. So the school didn’t accept him to take the same course so he planned to transfer. However, they had to let him pay again since he didn’t finish a year in his old school… They suggested to downgrade first his visa to tourist. But he had problems then with his finance. So he wasn’t able to enroll. Then, after a month, his visa was expired. He was not able to renew or pay the fines for 6 months.

Now I want to ask this. Do you have any idea how much total will he pay for the fines and everything? or estimation perhaps? He doesn’t want to be in the blacklist, so he wants to fix it. What are the consequences?

Today, the BI representatives at my university said that I would be deported and fined around 92000P. I apologize for my previous messages. They’re very vague sounding.

I came to the Philippines with a BB privilege in 2015, and I also planned to study in college. I was a minor (16) when I applied, so I filled out the forms for the SSP and the school said that we will start to convert once I’m 18. So for the year of 2015 – 2016 I had the SSP so I was okay.

Now that I am 18, I tried to process the conversion of SSP to a Student Visa for the school year of 2016 – 2017. I had all the papers and I submitted them in January. Like I said, I had intervening factors along the way that I couldn’t control, and I ended up being 1 month late. By that, I mean I had to pay for the processing fee but I don’t have enough time for the visa to be processed.

My BB privilege expires in March, and the visa would be done by March. So, the registrar representative told me to extend my visa (to a tourist, plus 2 months) so that I can process the visa for that year.

Questions:
1. I would have to pay P20k for each semester without a visa, for a total of P40k? Plus 1k late fee?
2. Would my student visa be valid for the year of 2016 – 2017 even though the school year is almost over?

I’m going to the immigration office to extend my visa and I hope I won’t be in trouble. Thank you for your time.

I would not have a student visa for the 2016 – 2017 school year. That is why I tried to process it but I was too late.

I was told to extend my stay here so that I can have the student visa processed, and then I can pick it up afterwards.
