Recognition of Foreign Divorce in the Philippines

A divorce can be recognized in the Philippines in cases of marriages between a Filipino and a foreigner, after the foreign spouse has obtained a divorce from his own country.

The 2nd paragraph of Article 26 of the Family Code of the Philippines provides that “Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law.

The two elements for the application of the above provision are:

  1. There is a valid marriage that has been celebrated between a Filipino and a foreigner.
  2. A valid divorce is obtained abroad by the alien spouse allowing him or her to remarry.

The divorce obtained by the foreign or naturalized spouse is NOT automatically recognized in the Philippines.

The Filipino party needs to file a case in court for the recognition of the foreign divorce.

Only until after the foreign divorce is recognized in the Philippines can the Filipino spouse enter into another marriage.
The recognition of the foreign divorce is mandatory if the Filipino party is to remarry.

One legal case with answer:

Republic of the Philippines versus Cipriano Orbecido 3 (G.R. 154380, October 5, 2005, 472 SCRA 114)

Given a valid marriage between two Filipino citizens, where one party is later naturalized as a foreign citizen and obtains a valid divorce decree capacitating him or her to remarry, can the Filipino spouse likewise remarry under Philippine law?

We are unanimous in our holding that Paragraph 2 of Article 26 of the Family Code (E.O. No. 209, as amended by E.O. No. 227), should be interpreted to allow a Filipino citizen, who has been divorced by a spouse who had acquired foreign citizenship and remarried, also to remarry.

This process will start taking effect on January 5, 2016, and will recur every 1st of the month thereafter.

What is an Alien Certificate of Registration or ACR-I Card?

Alien Certificate of Registration ACR-I Card

The ACR-I card is a requirement for foreign nationals to hold after a certain period of time in the Philippines. It is also required by those foreign nationals to be able to leave the Philippines, together with an ECC (Exit/Emigration Clearance Certificate) [not instead of].

The ACR-I card is issued at a Philippines Bureau of Immigration office.

The Tourist ACR-I card

The Tourist ACR-I card has a validity of ONE year, and must be renewed annually.

Originally, the ACR-I card had to be handed in at Immigration when leaving the Philippines. This has now changed, and you retain it now, and it is still valid if you come back before it expires.

Details:

The Clark Bureau of Immigration office moved from Clark to MarQuee Mall in October 2014.
Many visitors to this new office are seen wearing shorts. It appears that the old rule that shorts were not allowed (but revoked early in 2014) is not being enforced now.

This office processes ECC’s and Visa Extensions in a section right next to the supermarket, in what may have previously been some of the food court area. The waiting area is the seating outside the Comfort rooms at the end, to the right of the supermarket.

Emigration Clearance Certificates can be issued the day after application.

Alternatives to a jeepney are the local taxi at a return fare of 800 pesos, but the taxi driver will wait for you, and bring you back when finished.

On 3rd November, neither of the taxi drivers or Jeepney drivers were aware that the Clark BI had closed the previous month.

The Philippines Bureau of Immigration (BI) has stated that the following are needed to get an ECC – Exit Clearance Certificate (also called Emigration Clearance Certificate)

  • Completed application forms. (They supply numerous forms for you to fill in !!)
  • 6 pcs. colored photo (size 2×2 ) white background. (NOTE: SIX were needed, not the FIVE that web sites say.
  • Photocopy of passport (3 Pages: biopage, latest arrival stamp and last visa extension stamp).
  • Photo of both sides of Alien Certificate of Registration ACR card. (Must be Current NOT Expired)
  • Photocopy AND Original of the Receipt for payment of last visa extension fees. (To be issued with an ECC, you need up to date valid visas)
  • Current ACR-I card
  • A personal appearance is required for fingerprinting, both electronic scanning and manual ink, and photograph.

There are various forms available for download at: http://immigration.gov.ph/index.php/downloads/application-forms but… not for the Emigration Clearance Certificate (ECC) as it is now called.

An Emigration Clearance Certificate [ECC] is needed when Foreign Passport Holders are leaving the Philippines after a stay of 6 months or more.

Your passport may be stamped like this, when you get a visa renewal that takes you past 6 months after entry.

Any child, born in the Philippines, but travelling on a Foreign passport, NEEDS an ECC to leave the Philippines. A notice to this effect is on display at a Bureau of Immigration office.

To be issued with an ECC, you need up to date valid visas, and an ACR-I card.

The cost for an ECC-B in 2015 was mentioned by one person at 2,850 pesos. The cost was mentioned again in October 2018.

ECC-A for Visitor Visa Holders

The ECC-A may be secured at the BI Main Office or in select District Offices, Satellite Offices, Field Offices, One-Stop-Shops.
ECC-A is issued to departing holders of Tourist Visas who have stayed for 6 months or more. A valid ACR-i card is required for this when the Visitor visa holder has been in the country for over 2 months.
ECC-A is issued to departing holders of Immigrant and Non-Immigrant visas with valid ACR I-Cards and are leaving the country permanently.

ECC-B for other Than Visitor Visa Holders

The ECC-B may be secured at the BI Main Office or in the airport upon departure.
ECC-B is issued to departing holders of Immigrant and Non-Immigrant visas with valid ACR I-Cards and are leaving the country temporarily.

Update:

Confusion between ECC-A and ECC-B for Tourist Visa Holders

There is confusion on whether a Tourist Visa holder, leaving the country temporarily, and holding an ACR-I card, requires the ECC-A or the ECC-B.

Tourist Visa in the country over 6 months: ECC-A with no confusion. (ECC-A is issued to departing holders of Tourist Visas who have stayed for 6 months or more)

Tourist Visa in the country under 6 months: This is where the confusion arises, as the Tourist Visa holder must also have an ACR-I card (after 2 months) and the rules state: ECC-B is issued to departing holders of Immigrant and Non-Immigrant visas with valid ACR I-Cards and are leaving the country temporarily

However, even if the Tourist Visa holder is only leaving temporarily, their visa will normally expire on leaving, meaning it is a permanent exit on that visa, and they will return on a new visa, automatically given for most nationals, for a 30 day period, with the same conditions applying for a new temporary visa entry.

If the Immigrant or Non-Immigrant visa can be used for re-entry, then it could be classed as ‘leaving the country temporarily’, and selecting the ECC-B.

It is possible that some Tourist Visas may be able to be used for re-entry under those circumstances.

 

When the ECC was enforced in 2013, the reason for this certificate was given as follows:

Immigration Commissioner Siegfred Mison said that the ECC is being issued to departing foreigner nationals to prove that they have no derogatory records in the country or any accountability with other government agencies.

There are two types of ECC:

The ECC-A is being issued to foreigners who have tourist visas extending for more than six months. (A tourist visa holder in the country for over two months will also have a tourist ACR-i card)

The ECC-B, on the other hand, is given to holders of immigrant and non-immigrant visas with valid alien certificate registration I-Cards.

In Angeles City, Pampanga at least TWO shops are selling the Smart Bro Broadband SIM for 150 pesos (One Hundred and Fifty Peso) each, even though it has P50 marked on it. They both gave the same reason; that the p50 is the wholesale price, the price they pay!!

Driving Time between Angeles City and Baguio City

What is the Driving Time between Angeles City and Baguio City ?

A quick Google search reveals the travel time between Angeles City and Baguio City as 2 h 17 min to cover the 168.9 km going via Tarlac – Pangasinan – La Union Expressway and MacArthur Highway.

(Funny Bit): Google says it is only 164.0 km when walking (via MacArthur Hwy) but would take about 35 hours…

Going by bus would take longer than the 2 h 17 min stated as the car travel time, due to the various stops on the way.  I have seen these BUS times mentioned as between 5 and 7 hours for the trip. But I have also seen 4-6 hrs to get to Baguio, from Manila, by bus !!! The same website also says 4-6 hrs to get to Baguio, from Manila, by car.

From Manila: This is the most common and economical way to get to Baguio Cityfrom Metro Manila. Several bus lines ply the Metro Manila to Baguio route with terminals scattered across the metro. It generally takes about 4-6 hrs to get to Baguio by bus, longer than it would by car due to stops along the way.

From Manila to Baguio: Visitors need to keep in mind that while it takes at average 4-6 hr to get to Baguio by car, it takes much longer during holiday weekends like Holy Week.

But, back to the normal car trip… is Google accurate on that timing, how long would it really take ?

A taxi service recommended leaving Angeles at 9:00am to reach Baguio by 2:00pm. Thereby estimating a FIVE HOUR journey, twice as long as Google says.

When I said I didn’t want to get there BEFORE 2:00pm he changed it to 10:00am leaving time…  Maybe FOUR hours ??

We will see…..

We left at 9:30 and arrived in Baguio at 1:30. Four hours later, with no stops. The traffic wasn’t too bad, but could have been better. It could also have been a lot worse.

The latest Globe Surfing plans now have Monthly limits, but allow unlimited access at a cap of Php 1,500 pesos per month.  This is charged at 999 pesos for the GOSURF999 plan, plus an extra 2 pesos per MB used after the 5GB monthly allocation has been used, up to a maximum charge of 1,500 pesos for the month, assuming you have sufficient extra load on your SIM card.  501 pesos in the case of the GoSurf999 plan, or more for the lower charged monthly plans. Without extra load on your SIM, your internet access will end after the 5GB has been used.

[important]The Department of Justice reminded telco giants Smart Communications and Globe Telecom that “Unlimited” internet service means unlimited, and that the imposition of a fair usage policy on unlimited internet service is inconsistent with the provisions of the Consumer Act of the Philippines.
‘Unlimilted‘ Mobile Broadband plans seem to be no longer available from either Telco.[/important]

Until recently the common Globe unlimited Internet plan was the SUPERSURF999.

This SUPERSURF999 plan, at a cost of 999 pesos per month gave 30 days Unlimited Internet. The only drawback being that after reaching 800mb in 24 hours the service was cut back to a VERY SLOW speed..

This has now changed, as the SUPERSURF plan appears to have been withdrawn and replaced with the new GOSURF.

The GOSURF999 plan, at a cost of 999 pesos per month gives 30 days Internet, but limited to 5Gb during that 30 days.
It appears that if you use that 5Gb in, say 5 days, then your plan ends…..  Not exactly a good change for the customer ??

However, it does appear that you can still ACCESS the INTERNET after your 5Gb allocation has been used up, BUT, at a cost of 2 pesos per MB.  However, the latest information does state that you will pay no more than P1,500 for mobile surfing per month when you subscribe to the GoSURF 99 to GoSURF 999 plans.  You do need to ensure that you have another 501 pesos load on your SIM card, after paying the 999 for the GOSURF999 plan, (or 1,401 pesos if on the GoSurf 99 30 day plan), to be certain of getting the full 30 days Internet access.

5Gb Internet per month is 166.67 MB per day on average.  Much less than the original 800mb per day for “Unlimited” use.
